If you look, you can see the small debris line washed up by a previous tide. It does indeed look like the tide was out. Unfortunately, they may have enough time to get towed out of there.

Clearance has less to do with it than its massive curb weight.
Having finally go close to one IRL, they're taller than they appear from afar, good bit more than my 2004 F150. I was surprised.
Most of the ones I've seen have been tailgating me on the Beltway (simultaneously blinding me with their headlights), then very grumpily conceding that the cars in front of me were going the same speed before cutting someone else off in order to get a quarter car-length ahead. I will freely admit that I wasn't necessarily paying enough attention to their wheel clearance at the time.
Anyone who drives on a beach should lose their vehicle. Either by nature or by law enforcement.
There are plenty of beaches where it’s perfectly fine to drive off road. But it typically requires a permit, proper equipment, knowledge of how to properly deflate your tires, etc.
It also requires you to be a dick and not care about the environment.
